Dispute Resolution Process
Introduction
In the event of any dispute arising from or relating to the purchase or use of our furniture products, PolySleek Furniture is committed to resolving the matter in a fair and efficient manner. This Dispute Resolution Process outlines the steps to be followed to address and resolve disputes.
Step 1: Initial Contact
-
Notification: The customer must notify PolySleek Furniture of the dispute in writing within thirty (30) days of the occurrence of the issue. The notification should include a detailed description of the dispute, relevant documentation, and the desired resolution.
-
Acknowledgment: Upon receipt of the notification, PolySleek Furniture will acknowledge the dispute in writing within seven (7) business days.
Step 2: Informal Resolution
-
Discussion: Both parties will engage in good faith discussions to resolve the dispute informally. This may involve phone calls, emails, or meetings to understand the issue and explore potential solutions.
-
Resolution: If an informal resolution is reached, both parties will document the agreed-upon solution in writing. The resolution will be implemented within 90 days. Full resolution may take longer and will be dependent on multiple factors including if repair is needed or replacement is necessary, but not excluding other elements.
Step 3: Mediation
-
Request for Mediation: If the dispute cannot be resolved informally, either party may request mediation. Mediation is a voluntary process where a neutral third party (mediator) assists in resolving the dispute.
-
Selection of Mediator: The mediator will be selected by PolySleek Furniture from a recognized mediation organization.
-
Mediation Process: The mediator will facilitate discussions between the parties to reach a mutually acceptable resolution. The mediation process will be confidential, and any settlement reached will be documented in writing.
Step 4: Arbitration
-
Request for Arbitration: If mediation fails to resolve the dispute, either party may request arbitration. Arbitration is a binding process where a neutral third party (arbitrator) makes a decision on the dispute.
-
Selection of Arbitrator: The arbitrator will be selected by PolySleek Furniture from a recognized arbitration organization.
-
Arbitration Process: The arbitrator will conduct a hearing, review evidence, and make a binding decision on the dispute. The arbitration process will be governed by the rules of the selected arbitration organization.
-
Final Decision: The arbitrator's decision will be final and binding on both parties. The decision will be documented in writing and implemented within a reasonable timeframe.
